Terms of service

These terms are an agreement between PingPing ("we") and the company or person using the service ("you"). By creating an account or using PingPing you agree to them. If you use PingPing for a company, you confirm you may bind that company.

1. The service

PingPing provides tools to create, send and measure marketing email to business contacts in the life sciences. Some features are offered as early access or "coming soon" and may change or be withdrawn.

2. Your account

Keep your login details confidential and tell us about any unauthorized use. You are responsible for activity under your account. You must provide accurate information, including a valid company name and postal address for the emails you send.

3. Acceptable use

You must follow our Anti-spam and acceptable use policy, which is part of these terms. In particular, you may only send to recipients who have agreed to hear from you (for example by subscribing or opting in) or with whom you have an existing business relationship, such as customers and people who asked you for information. Purchased, rented, borrowed or scraped lists are prohibited. You must honor opt-outs. We may suspend sending, or your account, to protect recipients, deliverability or the service.

4. Your content and data

You keep ownership of your templates, images and lists. You give us permission to host, process and send them only to provide the service. You are responsible for having the rights to your content and lists. We handle personal data as described in our privacy policy.

5. Fees

Prices will be shown before you buy. Early-access prices are subject to change, and you won't be charged without agreeing to a price. Unless stated otherwise, fees are billed in advance and are non-refundable except where required by law.

6. Availability and changes

We aim to keep PingPing available but do not guarantee uninterrupted service. We may update the service and these terms; material changes will be announced in the app or by email, and continued use means you accept them.

7. Disclaimers

The service is provided "as is". We don't guarantee inbox placement, open rates or business results. AI-assisted writing may contain errors; review every email before sending.

8. Limitation of liability

To the extent permitted by law, neither party is liable for indirect, incidental, special or consequential damages or lost profits, and our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.

9. Indemnity

You will defend and indemnify PingPing against claims arising from your content, your lists, or your violation of these terms or the law.

10. Termination

You may stop using the service at any time. We may suspend or end your access for violations of these terms or to comply with law. Sections that by their nature should survive (such as ownership, disclaimers, liability and indemnity) survive termination.

11. Governing law

These terms are governed by the laws of the State of Maryland, USA, without regard to conflict-of-law rules. Courts located in Maryland have exclusive jurisdiction.
